Nectar 3PL, LLC dba Nectar Logistics ("Nectar," "we," "us," or "our") provides third-party logistics, warehousing, fulfillment, distribution, and related services. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information when you visit nectar3pl.com, contact us, engage us as a business partner, or otherwise interact with our services (collectively, the "Services").
1. Our Role in Processing Information
For website inquiries, sales activity, billing contacts, and our own business operations, Nectar generally determines why and how personal information is processed and acts as a controller or business.
When a client provides order-recipient or end-customer information so that Nectar can fulfill orders, Nectar generally processes that information on the client's instructions as a processor or service provider. The client determines the purposes of that processing and is responsible for its customer-facing notices and legal basis. End-customers should ordinarily direct privacy requests concerning fulfillment data to the brand or retailer from which they ordered. We assist our clients with those requests as required by applicable law and contract.

Product, catalog, inventory, integration, and operational information supplied by clients

Order, inventory, return, shipment, and transaction information
Order-recipient information needed for fulfillment, such as name, shipping address, telephone number, email address, order contents, and delivery instructions
Information exchanged through client-authorized e-commerce, marketplace, ERP, retail-compliance, CRM, warehouse-management, or other integrations
2.3 Information Collected Automatically
Internet and device information, such as IP address, browser type, device identifiers, operating system, referring URLs, pages viewed, and approximate location derived from IP address
Website interaction and diagnostic information, such as dates and times of visits, links selected, form interactions, and error or performance data
Cookie and similar-technology information described in Section 7
3. How We Use Information
Provide, operate, administer, support, and improve the Services
Receive inventory; process, pack, ship, and return orders; and provide account reporting
Respond to inquiries, prepare quotes, and manage sales, onboarding, and client relationships
Configure and support client-authorized integrations
Authenticate users, maintain system and facility security, prevent fraud, and investigate misuse
Process billing, maintain business records, and enforce agreements
Analyze website performance and improve functionality and user experience
Send service communications and, where permitted, marketing communications that recipients may opt out of
Comply with legal, regulatory, contractual, insurance, accounting, and reporting obligations
Establish, exercise, or defend legal claims and protect the rights and safety of Nectar, our clients, and others
4. How We Disclose Information
We may disclose the categories of information described above to the following categories of recipients for legitimate business and operational purposes:
Carriers, freight providers, postal services, customs providers, and delivery partners
Warehouse-management, hosting, cloud-storage, cybersecurity, analytics, CRM, communication, payment, accounting, and other operational service providers
Client-authorized e-commerce, marketplace, ERP, retail-compliance, and integration platforms
Professional advisors, auditors, insurers, banks, and financing providers
Government authorities, regulators, law enforcement, courts, or other parties when disclosure is required or reasonably necessary to comply with law or protect rights and safety
A buyer, investor, lender, successor, or other transaction participant in connection with a merger, acquisition, financing, reorganization, or sale of business assets, subject to appropriate confidentiality protections
We do not sell personal information for monetary consideration. We also do not knowingly sell sensitive personal information. If website advertising technology is configured in a manner treated as targeted advertising, a sale, or sharing under applicable law, visitors may opt out as described in Sections 7 and 9.
5. Legal Grounds for Processing
Where applicable law requires a legal basis, we process personal information to perform or prepare to enter a contract, pursue legitimate business interests that are not overridden by individual rights, comply with legal obligations, protect vital interests or legal rights, and obtain consent where consent is required. When we process fulfillment data for a client, we rely on the client's instructions and contractual authorization.
6. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed for the nature and volume of information in our care. Measures may include restricted facility access, role-based system access, authentication controls, vendor oversight, workforce confidentiality obligations, secure handling procedures, and incident-response practices. No system or transmission method is completely secure, and we cannot guarantee absolute security.
7. Cookies and Similar Technologies
Our website uses cookies and similar technologies for functions such as security, basic operation, form submission, remembering preferences, measuring performance, understanding website use, and supporting communications. Depending on the tools enabled on the website, these technologies may be provided by website-hosting, analytics, CRM, scheduling, embedded-content, or advertising vendors.
You can control cookies through available website cookie settings and your browser or device settings. Blocking necessary cookies may prevent parts of the website from functioning. Where required by law, we request consent before enabling non-essential cookies and honor applicable opt-out preference signals, such as Global Privacy Control, when we are legally required and technically able to do so. 8. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing Services, maintaining client and transaction records, resolving disputes, enforcing agreements, meeting tax, accounting, insurance, and legal requirements, and maintaining security. Retention periods vary based on the type and sensitivity of information, the duration of the business relationship, client instructions, legal limitation periods, and applicable contractual or regulatory requirements. We then delete, de-identify, or securely dispose of information, subject to lawful backup and archival practices.
9. Your Privacy Choices and Rights
Depending on your state or country of residence and our relationship with you, you may have the right to:
Confirm whether we process your personal information and access it
Correct inaccurate personal information
Request deletion of personal information
Receive certain information in a portable and usable format
Opt out of targeted advertising, the sale of personal information, or qualifying profiling
Withdraw consent where processing is based on consent
Appeal our refusal to act on a privacy request
Opt out of marketing email by using the unsubscribe link or contacting us

Please describe the request and the relationship or transaction involved. We may request information reasonably necessary to verify identity and authority. You may use an authorized agent where permitted by law, subject to verification of the agent's authority. We will not discriminate against you for exercising an applicable privacy right.
We generally respond to verified requests within 45 days when required by applicable law. If we deny a request, our response will explain the reason and how to appeal. You may appeal by replying to the decision or contacting us through another method in Section 12 and stating that you are submitting a privacy appeal. If an appeal is denied, Nebraska residents may submit a complaint through the Nebraska Attorney General's consumer complaint process.
For information Nectar processes solely on a client's behalf, we may direct the request to that client or notify the client so it can respond.
10. Children's Privacy
Our website and Services are directed to businesses and are not intended for children under 18. We do not knowingly collect personal information online directly from children under 13. If we learn that we collected such information without authorization required by law, we will take reasonable steps to delete it. Fulfillment records supplied by clients may incidentally identify an order recipient, but Nectar does not use that information to determine the recipient's age or market directly to children.
11. Changes to This Policy
We may update this Privacy Policy to reflect changes in our practices, technology, Services, or legal obligations. We will post the revised Policy with an updated effective date and provide additional notice when required by law. The version in effect when information is processed governs our practices, subject to applicable law.
